1. Service overview

These Terms of Service ("Terms") govern the access and use of Zhoot, available at https://zhoot.app (the "Service").

GESWORK SAS, a simplified joint-stock company registered in Pontoise (France) under number 825 339 872, subsidiary of Holding GSME, SAS registered under number 841 339 245, headquartered at 5 rue des Sources, 95640 Brignancourt, France.

Zhoot is an AI-powered visual creation platform that allows users to upload product photos, generate professional packshots, create AI models, and build virtual shooting scenes.

2. Acceptance of terms

By accessing or using the service, the user acknowledges having read and accepted these Terms without reservation.

GESWORK SAS reserves the right to update or modify the Terms at any time. Updates take effect upon publication on the website.

3. Account and access

Using Zhoot requires creating an account via e-mail or Google login. Each new user receives 10 free image credits upon registration. Further use requires a paid subscription managed through Stripe.

4. Features

Zhoot provides:

• • Creation of AI models and virtual scenes
• • Secure image storage and download (via Amazon S3)

5. Intellectual property

All images generated via Zhoot are the exclusive property of the user. By using the platform, the user grants Zhoot a limited, non-exclusive license to host, process, and display their content solely for technical and operational purposes.

Users are responsible for ensuring they own all necessary rights (images, logos, faces, brands, etc.) and that their use of the service does not infringe upon third-party rights.

6. Prohibited content

Users must not create or distribute any content that is:

• • illegal, defamatory, discriminatory, or violent
• • sexually explicit, hateful, or unethical
• • infringing upon privacy, copyright, or image rights

GESWORK reserves the right to suspend or delete accounts violating these rules.

7. Payment and billing

Payments are processed via Stripe. Refunds are not provided unless required by law. Subscriptions can be canceled anytime; ongoing billing periods remain due.

8. Liability

Zhoot is provided “as is”, without any warranty of accuracy or performance. GESWORK SAS shall not be held liable for:

• • errors or imperfections in AI-generated content
• • unlawful or infringing use of the platform
• • any indirect damage or data loss

GESWORK SAS's liability is limited to the amount actually paid by the user over the past 12 months.

9. Personal data

Zhoot collects only essential user data: name, email, and usage history.

All data is processed under the EU General Data Protection Regulation (GDPR).

10. Updates to Terms

GESWORK may update these Terms at any time. Updated versions take effect immediately upon being posted on the website.

11. Governing law

These Terms are governed by French law. Any dispute shall be submitted to the exclusive jurisdiction of the Courts of Pontoise, France.
